The following Terms and Conditions apply to all visitors or users ("you," "your," or "yours") of our Website and of our webpages (collectively, our “Services”). By using our Website, you agree to be bound by these Terms. We reserve the right to modify the Terms at any time. Changes and clarifications will take effect immediately upon their posting on the Website. If you do not agree to any of these changes, you must discontinue using the Website.
PRODUCTS & CONTENT
All Bilum & BIlas content, products and prices shown on this site are subject to change with out notice at anytime. We make the best effort to display correctly the images and descriptions of our products, including the colours. All pieces are handcrafted so have individual characteristics and colour tones that may vary depending on your computer screen.
CARE INSTRUCTIONS
Please avoid exposing your Bilum & Bilas piece to moisture as this may damage natural fibres. Store in a sealed box in a cool, dry place when not in use to keep it dry. Apply any lotions, perfumes and creams prior to wearing your Bilum & Bilas piece as these can all effect the integrity of the natural fibres and metals. Please remove before showering, exercising or swimming. Our pieces may change colour over time due to the natural fibres used in each piece. This is a normal and natural occurrence of the fibres used in our products. A care card is included with each piece.
PLACING AN ORDER & ORDER CONFIRMATION
Please follow the check out instructions to place your order. Once we have received the order, we will send you an Order Confirmation via email to acknowledge that we have received your order. All orders are subject to approval by Bilum & Bilas. Some pieces are made to order and it can take up to 4 weeks to dispatch your item. You will be notified if your item needs to be made to order and given an estimated processing time. Please send an email to info@bilumandbilas.com if you need to know further information on processing timeframes. We will accept and confirm your order is ready by sending you a Shipment Confirmation via email. We reserve the right to cancel your order at any time before we have accepted it and we may withdraw our approval and cancel your order where there has been an obvious error in price or where the products are no longer in our inventory. We also reserve the right, without prior notice, to limit the order quantity on any product or service and/or to refuse service to any customer. We may also require verification of information prior to the acceptance and/or shipment of any order.
REFUNDS & RETURNS POLICY
We only accept refunds and returns on faulty items. You must request a refund within 14 days of receiving the item. Please send a photo of the return postage receipt as proof of shipping. The item/s must be in original condition, with the original packaging and with all tags still attached. Items returned without the tag attached in its original condition will not be accepted. Item/s must not have been worn, washed or altered in any way (we cannot accept items that have makeup stains or that smell of perfume). The item/s must be returned to us before the refund is made. The cost of the original freight and the return postage will not be reimbursed or refunded. We are happy to replace, repair or refund due to a manufacturing fault but not normal ‘wear and tear’. Please follow the care instructions on your Bilum & Bilas piece to prolong its life. We are unable to refund initial shipping charges for goods returned other than for faulty items. We are also unable to refund return postage costs. Once the items have been received, you will receive your refund (excluding original shipping cost). Bilum & Bilas cannot be held liable for the loss of items being returned.
FAULTS & REPAIRS POLICY
Where possible we will offer repairs to products for a small fee (usually $10/K25 per product excluding shipping) unless due to a manufacturing fault. Manufacturing faults will be repaired, or replaced and shipped for free if notified within 21 days of purchase. We may consider faults up to six months within purchase at our discretion. Anything over six months from purchase will incur a repair charge.
INTELLECTUAL PROPERTY RIGHTS
The Website and all of its content, including but not limited to, its software or HTML code, scripts, text, artwork, photographs, images, video, and audio are the intellectual property of Bilum & Bilas the label. All content is provided by Bilum & Bilas as a service to its current and prospective customers and may be used for personal use and for purchasing purposes. You are authorised to print a copy of any information contained on this Website for personal use unless such printing is expressly prohibited. Without limiting the foregoing, you may not, without our written permission, sell information obtained from this Website. You may not copy, alter, reproduce, publish, transmit, distribute, perform, display, post, modify, create derivative works from, sell, license, or otherwise exploit this Site or any of its content without our prior written permission. You may not use this Website, or any of its content, for any commercial purposes, including any advertising or advertising revenue generation activity on your own Website. Any unauthorised copying, alteration, distribution, transmission, performance, display, or other use of these materials is prohibited. Reproduction or misuse of any trademarks and logos on the Website is strictly prohibited. Bilum & Bilas and its affiliated suppliers retain all rights regarding their trademarks, trade names, brand names and trade dress. These marks, names or trade dress, and all associated logos or images, are registered and/or common law trademarks and are protected by local and international laws and treaties. No license to the use of such marks, names or trade dress is granted to you under these Terms.
ACCEPTABLE USE OF THE WEBSITE
You agree that: You will not misuse our Services (e.g., you will not use our Website in any way which is unlawful, illegal, fraudulent or harmful). You will not make any speculative or fraudulent orders. You will not conduct systematic or automated data collection activities (including without limitation scraping, data mining, and data harvesting). You will not alter another website so as to falsely imply that it is affiliated or associated with Bilum & Bilas. You may only use the Website to make legitimate orders and inquiries. You are responsible for all use of your account (under any user name or password) and for ensuring that all use of your account complies fully with the provisions of these Terms.
TERMINATION OF SERVICES
Bilum & Bilas may terminate the Services or any portion thereof, or any products or services offered through the Website.
YOUR RIGHTS
You have the right to expect that: 1. Any products you order through the Website will be of satisfactory quality, fit for their intended purpose, and will conform to the description given on this Site; 2. Certain remedies will be followed if a product is agreed to be defective; 3. You have the choice of a full refund or a store credit if a defective product cannot be repaired or replaced. REGISTRATION
To use some of the services or features made available to you on our Website, you will need to register. When you register, you are required to provide information about yourself that is true, accurate, current and complete in all respects. BILUM & BILAS ACCOUNT
As a Bilum & Bilas account holder, you agree that you will be personally responsible for the use of your account and for all of your communication and activity on and pursuant to this Website. If we determine that you are or have been engaged in prohibited activities, were not respectful of other users, or otherwise violated our Terms, we may deny you access to this website on a temporary or permanent basis.
PRIVACY POLICY
Prices displayed on the Bilum & Bilas website are all in AUD with the choice to select your local currency. We attempt to ensure that information on this Website is as accurate and current as possible. We reserve the right to change prices, product availability and descriptions at any time. At times the information displayed may occasionally be inaccurate, or out of date. We also reserve the right to alter the terms of any special offers or sales periods and sale stock at any time. The responsibility for any custom duties, foreign taxes or other fees, which may be imposed, will rest with the customer. Please contact your local customs offices if you would like to seek more information regarding taxes and duties.
ELLIGIBLITY TO PURCHASE
Purchasing products on the Website is only available to individuals who meet our terms of eligibility. All purchasers must be over 18 years of age. All purchasers must have been issued with either a valid credit card by a bank acceptable to PayPal or a valid PayPal account. The individual’s application to open an account must be acceptable to Bilum & Bilas. All purchasers must agree to authorise PayPal (on behalf of Bilum & Bilas) to process the charge or charges on his/her credit card or PayPal account in the amount of the total purchase price for the merchandise which they purchase. By making an offer to purchase a merchandise, you expressly authorise PayPal (on behalf of Bilum & Bilas) to perform credit checks to validate your credit card, to obtain an initial credit card authorisation and to authorise individual purchase transactions. Furthermore, you agree that PayPal (on behalf of Bilum & Bilas) may use personal information provided by you in order to conduct appropriate anti-fraud checks. Personal Information that you provide may be disclosed to a credit reference or fraud prevention agency, which may keep a record of that information.
ORDER APPROVAL
All orders are subject to acceptance and availability. Please note that items in your shopping cart are not reserved and may be purchased by other customers. After you place your order, you will be sent an e-mail to confirm that your credit card or PayPal account has been charged. Your card/PayPal account is debited at the same time you submitted your order on our Website. If your order has not been approved, you will be notified immediately via our Website or by PayPal. In the rare instance that your order is approved but any of the items you have ordered are not available, we will contact you immediately by e-mail to arrange for a full refund. Unless you cancel your order, acceptance of your order and completion of the contract between you and Bilum & Bilas will be completed when we e-mail you to confirm the goods have been dispatched. The Website and communication is always conducted in English; therefore, the final sale contract will also be in English. We reserve the right to not accept your order in the event, for example, that we are unable to obtain authorisation for payment, that shipping restrictions apply to a particular item, that the item ordered is out of stock or does not satisfy our quality control standards and is withdrawn, or that you do not meet the eligibility criteria.
CANCELLATION BY US
At Bilum & Bilas, we will do our best to ensure your order is fulfilled. However, we reserve the right to cancel the order if we do not have sufficient stock, or it is not possible to make your piece to your order. In the event of cancellation, we will contact you by e-mail within 24 hours of receiving your order. If we cannot fulfil the order, we will re-credit your account immediately. Bilum & Bilas will re-credit your account for the value of the goods and shipping only. Bilum & Bilas does not reimburse any bank charges you may have incurred in the transaction. Please note card refunds may take up to 10 business days for your bank to complete, depending on their processing time. This can vary greatly between card issuers, and unfortunately, we are unable to influence this.
CANCELLATION BY YOU
Bilum & Bilas aims to ship any orders received within 1 week (excluding weekends and public holidays or if item needs to be made to order when you will be notified with a different fulfilment estimate). If you contact us and the order has already been made or shipped, we cannot cancel the order. However, if the order has not been made or shipped, Bilum & Bilas will happily cancel the order and refund you.
INSURANCE AND DELIVERY
Bilum & Bilas insures each purchase during the time it is in transit until it is delivered to your specified delivery address. We require a signature for any goods delivered, at which point responsibility for your purchased goods passes to you. If you have specified a recipient who is not you for delivery purposes (for example as a gift) then you accept that evidence of a signature by them (or at that delivery address) is evidence of delivery and fulfilment by Bilum & Bilas and transfer of responsibility in the same way. Bilum & Bilas cannot be held responsible for courier delays and circumstances out of our control. Estimated delivery times are to be used as a guide only and commence from the date of dispatch. Bilum & Bilas is not responsible for any delays caused by destination customs clearance processes.
CUSTOMS TAXES AND DUTIES
All our products are shipped as DDU (Delivery Duty Unpaid). Bilum & Bilas is not responsible for any possible duties and taxes which may be applied by customs in the country where delivery is made. The responsibility for any custom duties, foreign taxes or other fees, which may be imposed, will rest with the customer. Please contact your local customs offices if you would like to seek more information regarding taxes and duties.
PROMOTION CODES
Promotion codes are non-transferable and there is no cash alternative. Furthermore, they cannot be used in conjunction with any other promotion code or offers, and must be redeemed by the date published, if provided. Only one promotional code per customer can be used.
